Hi question on 401 K loan |

I took a 18k loan out in 2005, with a 5 year repayment. But I was terminated from my job last May 2008 with 8781 left to pay. I never got a 1099r from my
company at all. When was I to receive it? I did however get my W2s. I didin't realize i was supposed to have a 1099r to report penalties but my employer
never sent me one so I did my taxes without them. I see my quarterly benefits statement and it looks like the loan is still there, and it didn't say
defaulted loan. It also didn't look like the loan increased in amount over time. I am just confused now. Even though I was status: terminated, they still
have my loan there as not yet defaulted. Is there a certain wait time before the loan goes into default? I thought it was just 30-90 days which would make it
wellll past my termination date. Would it count towards my 2009 taxes instead of an amended 2008? Is my former employer at fault for not sending the 1099
before this tax year like I thought they should?

Usually they're supposed to default the loan within 90 days. They definitely have not, so you don't have to worry about the 1099 for '08.
The reason your loan balance is increasing is because they are still accruing interest on your loans. So, you probably want to call the employer and ask them to default it. Then you'll receive a 1099 for '09 next Jan/Feb.
