I found two links about Permissible Withdrawals and know what they are...
http://www.irs.gov/pub/irs-tege/se110707.pdf http://www.tri-ad.com/pdfs/Auto_Enroll_07.pdf I still have a question though, according to the two links above, Permissible Withdrawals of pre-tax Elective Deferral should be taxed when returned to the participants who opt out of the plan, which only makes sense, BUT I work for a financial institution and my co-workers are saying that P/W of pre-tax Elective Deferral should NOT taxed; am I missing something? |

So what do your co-workers reference to support their position that such withdrawals are not taxable?

I've asked that, and they told me that that's what the Compliance department told them. I will further investigate this.
